Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Shambld mobile app and website (together, the "Service"), operated by Engeforge LLC, a Washington State limited liability company ("Engeforge," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Shambld is — and is not

Shambld is a software tool for organizing and scoring social events. We provide event coordination, RSVP tracking, scorekeeping, leaderboards, and discovery features.

Shambld does not host, organize, sponsor, supervise, sell, serve, supply, or furnish alcohol or any other beverage, and is not a party to any event listed on the Service. Events are created and run entirely by users acting as independent organizers and hosts. We do not verify, endorse, control, or take responsibility for any event, venue, organizer, attendee, or activity. Any reference to "bar golf," "olympics," "crawl," or similar is a description of a user-organized social activity, not an offer or encouragement to consume alcohol.

2. Age requirement

You must be of legal drinking age in your jurisdiction (21 years of age or older in the United States) to create an account or use the Service. By using the Service, you represent and warrant that you meet this requirement. We may suspend or terminate any account we believe belongs to a person under the legal drinking age.

3. Drink responsibly — assumption of risk

Events organized through the Service may involve the consumption of alcohol. Consuming alcohol carries inherent risks, including but not limited to impairment, injury, illness, property damage, and death, and may affect your ability to drive or operate machinery safely.

You are solely responsible for your own conduct, consumption, safety, and decisions, and for those of your guests. You agree to drink responsibly, know your limits, never drink and drive, arrange safe transportation, and comply with all applicable laws. By using the Service and attending or organizing any event, you knowingly and voluntarily assume all risks associated with that event and with the consumption of alcohol.

4. Organizer responsibilities

If you create or host an event, you are the organizer and host of that event, not Engeforge. You are responsible for the lawful and safe conduct of your event, including compliance with all applicable laws, licensing, venue rules, and the safety of your attendees. You agree not to over-serve, serve minors, or encourage unsafe consumption, and to take reasonable steps to promote attendee safety.

5. User content and conduct

You are responsible for the content you submit, including event details, profiles, scores, and messages. You retain ownership of your content and grant us a non-exclusive license to host and display it as needed to operate the Service. You agree not to use the Service to break the law, harass others, post misleading event information, or encourage dangerous behavior.

We do not pre-screen user content and are not responsible for content created by users. We may remove content or suspend accounts that violate these Terms at our discretion.

6. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or accurate, or that any event, venue, or information presented through the Service is safe, lawful, or as described.

7. Limitation of liability

To the fullest extent permitted by law, Engeforge LLC and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, personal injury, illness, death, property damage, or damages arising from or related to: your use of (or inability to use) the Service; any event, organizer, attendee, venue, or activity discovered or coordinated through the Service; the consumption of alcohol; or the conduct of any user or third party.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid us, if any, in the twelve months before the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

8. Indemnification

You agree to indemnify and hold harmless Engeforge LLC and its members, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, any event you organize or attend, your content, your violation of these Terms, or your violation of any law or the rights of any third party.

9. Dispute resolution and arbitration

Please read this section carefully — it affects your legal rights. You and Engeforge agree that any dispute arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration, rather than in court, except that either party may bring a claim in small claims court if it qualifies.

Class action waiver: You and Engeforge agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. You may opt out of arbitration within 30 days of first accepting these Terms by emailing us at the address below.

10. Governing law

These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws rules. Subject to the arbitration section above, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in King County, Washington.

11. Termination

You may stop using the Service at any time and request account deletion. We may suspend or terminate your access at any time if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

12. Changes to these Terms

We may update these Terms as the Service evolves. If we make material changes, we will update the "Last updated" date and may ask you to re-accept the Terms in the app. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
